Getting A Marriage license through a New York Notary Public

If you need a marriage license and you’re planning on a vacation wedding, or eloping in New York, you might want to look into your do’s and don’ts, before you say ‘I do’.

1. Notarizing your prenuptials

Whether or not you’re planning ahead, it is important to know that in the state of New York A prenuptial agreement must be signed by both parties and notarized for it to be considered legally binding. However, it is not mandatory to have one before marriage and one can be drafted after the fact, if both parties agree to the terms.

2. Waiting period after licensing

It is simple to miss the minor details when planning a wedding, but did you know that often the most important things missed are the things you didn’t even know you needed. For example, did you know that in NY you have to wait 24-hours after you get your marriage license in order to have your ceremony. So, if you wait until the last day to get this done you may not be able to get married on D-Day.

3. Getting your marriage license in the state you plan to file in

A New York State marriage license may only be used within New York State. Meaning, that you must have your wedding ceremony in NY if you plan to file your license here. So, if you’re planning on a vacation wedding or eloping in NY while your here, you may want to look into a longer stay.

4. How long is my marriage license valid for?

You have 60 calendar days, after your license is issued to use it. So, planning ahead is key to making sure your wedding goes off without a hitch. If you or your future spouse are active U.S. military, this time may be extended by providing proof before your signing. If this is the case, notify your notary before your schedule appointment and he or she will inform you of the necessary steps to take.

5. What will your name be after the I 'do's'

A person’s last name, also known as a surname, does not automatically change upon marriage. You may elect to change your surname by entering your new name in the appropriate space provided, on the marriage license at the time of signing.

Whether or not you decide to use this option at the time of your marriage license application, you can still adopt a different surname at a future date. However, you will not be able to change your marriage license application to include a surname adopted at a later date.

6. What counts as proof of identity?

When getting married, you and your partner are required to present proper documentation when applying for a marriage license.  Below is a list of documents that may be required.

  1. Birth Certificate
  2. Passport
  3. A Driver’s license
  4. A government identification card with a photograph
  5. Immigration record or
  6. A naturalization records

7. If you've been married before

A certified copy of the Decree of Divorce or a Certificate of Dissolution of Marriage will most likely be required by your signing agent, along with any information on your previous marriages. This must be provided during your marriage license application. Including but not limited to, the current status of the previous marriage and when or where the divorce(s) took place.

8. What can a mobile notary public in New York do?
